Acceptance of Terms

By downloading, installing, or using Flight Mode Chat ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Flight Mode Chat is a decentralized messaging application that enables communication between devices using Bluetooth Low Energy (BLE) mesh networking. The App operates without requiring internet connectivity or server infrastructure for basic messaging functionality.

Subscription Terms

Premium Subscription Tiers

Flight Mode Chat offers the following auto-renewable subscription options:

• SkyLink Pass: Monthly subscription providing unlimited messaging and premium features
• Horizon Pass: Annual subscription with enhanced features and better value
• Navigator Pass: Lifetime subscription with all premium features and priority support

Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. Apple will notify you if the price of a subscription increases and ask for your consent to continue.

Free Trial

Free users can send a limited number of messages to experience the service. Premium features require an active subscription.

Payment and Refunds

Payment Processing

All payments are processed through Apple's App Store. Payment will be charged to your Apple ID account at the confirmation of purchase.

Refund Policy

Refunds are handled by Apple according to their standard refund policy. We do not process refunds directly. To request a refund, contact Apple Support or use the "Report a Problem" feature in the App Store.

No Refunds for Partial Use

No refunds will be provided for unused portions of subscription periods. If you cancel your subscription, you will continue to have access to premium features until the end of your current billing period.

User Conduct

Prohibited Uses

You agree not to use Flight Mode Chat for:

• Any illegal activities or to violate any laws
• Transmitting malicious code, viruses, or harmful content
• Harassment, abuse, or harmful communication toward other users
• Spamming or sending unsolicited commercial messages
• Circumventing or attempting to bypass any security measures
• Reverse engineering, decompiling, or disassembling the App

Content Responsibility

You are solely responsible for all content you transmit through the App. Since Flight Mode Chat operates on a decentralized mesh network, messages are transmitted between devices without server oversight.

Intellectual Property

Flight Mode Chat and all associated intellectual property rights are owned by Avinash Kumar. The App is licensed, not sold, to you for use strictly in accordance with these Terms.

License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Flight Mode Chat for personal, non-commercial purposes.

Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

Service Availability

No Guaranteed Uptime

Since Flight Mode Chat operates on a peer-to-peer Bluetooth network, service availability depends on device proximity and Bluetooth connectivity. We do not guarantee continuous service availability.

Updates and Modifications

We may update, modify, or discontinue the App at any time without prior notice. We may also modify these Terms at any time by posting the updated Terms in the App or on our website.

Disclaimers and Limitations

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Termination

We may terminate or suspend your access to the App at any time for violation of these Terms. Upon termination, your right to use the App will cease immediately. Subscription fees are non-refundable upon termination for cause.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where the App developer is located, without regard to conflict of law principles.

Apple App Store Terms

If you downloaded the App from Apple's App Store, you acknowledge that:

• These Terms are between you and Avinash Kumar, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
